Foreclosure / mortgage surplus

Yes — we recover this here.

How the claim moves

Trust-deed default: trustee applies proceeds, surplus to grantor (86.794). Judicial/execution: sheriff to court administrator; distribution order (18.950).

Deadline: No statutory surplus-claim deadline found for trustee sales; disputes → interpleader.

Non-judicial OTDA dominates. No pre-escheat fee cap or assignment bar found. Junior recorded liens take before grantor (86.794(3)).

Tax sale overages

We work these under a direct service agreement with you — state law restricts assignments here, and we honor that.

How the claim moves

County determines surplus ≤60 days after sale deposit; delivers to State Treasurer as UP; owner claims under 98.392/98.396 (312.530–.560).

Deadline: Claim arises at county disposition (312.540(1)); no interest during redemption. Writ of review of surplus amount available.

HB 2089/2025 c.475 (eff. 9/26/25) post-Tyler. Applies if 312.125 notice on/after 5/25/23. Claimant excludes assignees; assignment void except POA/bankruptcy/guardianship (312.540(5)(b)).

Courtroom requirement: Process here varies enough that we route files through counsel review — included in the same contingency deal.

If nobody claims it: Tax surplus is UP immediately (312.560). Mortgage leftover follows holder dormancy then Treasurer. No statutory finder % cap; Treasurer may deduct ≤10% locate costs (OAR 170-140-0010).

Cars, boats & RVs in Oregon: Vehicle/boat/RV repo surplus: UCC § 9-615(d) obliges the LENDER to return the surplus; § 9-616 explanation on request; § 9-625(c)(2) statutory damages for noncompliance. Demand-letter work against the secured party — no county, no state surplus-fee cap in this table.

This page summarizes public statutes for general information — it is not legal advice, rules change, and unverified items are confirmed by our desk (and counsel where needed) before any agreement is papered.
